A distinction is made here between ‘commercial use’ and ‘non-commercial use’. I wonder whether public services fall under the non-commercial category.

The public sector is a grey area; it depends on how the VMs are used, i.e. what is actually done with them.
The public sector falls under institutional use, which can also be assumed to include commercial use.
It is therefore advisable to either check with VMware beforehand or purchase licences straight away to be on the safe side. There was a ruling against Deutschlandradio in a similar case.

Public services such as municipalities, districts, states and the federal government fall under CU. The situation is different for schools, universities, etc.

Something that confirms your assertion. Schools and universities, etc., are also part of the state, and the public sector is not allowed to make a profit, which is why they are not commercial, I think. That's exactly what I wrote above. However, the public sector is allowed to make a profit. Ultimately, it depends on the legal form. But we're not in a law forum.
